Turkey Discusses New Alimony Calculation Formulas Instead of Lifetime Payments
Turkey is discussing the possibility of cancelling lifetime alimony after divorce and new formulas for calculating alimony payments. No deadlines have been set yet.

Turkey is discussing the possibility of cancelling lifetime alimony after divorce. According to CNN TÜRK, new formulas for calculating such payments are under consideration. The draft law was expected to be submitted to parliament; however, according to available information, President Recep Tayyip Erdoğan has asked for the proposals to be studied more thoroughly.
According to information obtained from sources in the Justice and Development Party (AK Parti), proposals on alimony and marriage-related matters were presented to Erdoğan. He instructed that the views of all sides be heard and that the work be prepared in more detail.
Among the options considered, the minimum alimony period is no less than three years. Another proposal envisaged that the payment period should not exceed half the period from the start of the marriage until the filing of a divorce petition.
Before a decision is made, it is planned to hear the views of women's organisations, academic specialists and institutions with which the Ministry of Family and Social Services maintains contact, as well as family courts. Several alternatives are expected to be developed on the basis of the opinions received.
The Role of the Judge and Acceleration of Divorces
The right of the judge to make a discretionary decision is also under discussion. Under one idea, when considering the duration of the marriage and the economic position of the parties, a court could in necessary cases assign lifetime alimony.
A separate model for accelerating divorce proceedings is also being considered. Under it, the requirement for divorce would first be decided, while questions of alimony, division of property and custody of children could be considered in separate proceedings, since they may delay the case.
According to the report, it is unclear whether the regulation of alimony will be included in the 13th judicial reform package, because work on the document is ongoing. Measures to implement court decisions are expected to appear at the beginning of the new year, according to expectations.
